These terms apply to every placement on the Outbig leaderboard. Your counterparty is the media owner named in the imprint.
A bid buys a publicly visible bid balance — not a particular position, and not a position for a period of time.
Rank follows at every moment from comparing all bid balances. A higher bid by someone else pushes your listing down without giving rise to any claim against us. On equal balances the older listing keeps the higher rank.
Submitting the checkout is a binding offer. The contract is formed when our payment provider confirms the payment.
An open, uncompleted checkout reserves no rank. While you pay, other bids can move ahead of you. Any rank shown beforehand is an estimate, not a promise.
Bids are whole US dollars, from 5 to 999,999. Raising an existing listing costs only the difference to its current balance.
Payment is handled by Stripe, using the payment methods offered there.
You may submit a product website or an @handle. Invitation and chat links, sexual or age-restricted content, affiliate and redirect links, and URL shorteners are not permitted.
Tracking parameters are stripped from submitted addresses. A shortened link is replaced by the address it redirects to.
We may freeze or remove listings that breach these terms or applicable law. The rules in force carry a version identifier on the rules page and are recorded with every bid.
A completed bid is not refunded merely because its rank later changes. That risk is precisely what the service is about, and it is acknowledged explicitly before payment.
If we freeze or remove a listing for a reason you are not responsible for, we refund the remaining bid balance pro rata.
Your statutory right of withdrawal as a consumer is unaffected; see the withdrawal page.
We are liable for intent and gross negligence. For slight negligence we are liable only for breach of material contractual duties, limited in amount to the sum paid for the listing concerned.
We owe no particular number of clicks, visitors, or sales, and no uninterrupted availability of the leaderboard.
These limitations do not apply to injury to life, body, or health, nor where mandatory law provides otherwise.
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer habitually resident in the European Union, the mandatory consumer protection rules of your country of residence remain unaffected and the statutory place of jurisdiction applies. Towards businesses, the court with subject-matter jurisdiction at the media owner's seat has exclusive jurisdiction.
